V příspěvku jsou diskutovány výsledky analýzy právních pojmů "odstraňování odpadu" a "energetické využívání odpadů" provedené na základě legislativy České republiky a dotčených předpisů Evropského společenství, včetně dokumentů Evropského soudního dvora týkajících se této problematiky.

The paper is focused on the analysis of the juridical commentary of various alternatives of waste treatment acording the regulations of Czech Republic and EU, incluiding the documents of European Judge Court. Particulary the are discussed the concepts of "waste removing" or "energetic ultilizing of wastes"
